1. Acceptance of Terms

By downloading, installing, or using the Pocket Memo mobile application ("App") or accessing our website (pocketmemo.com), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or website.

These Terms constitute a legally binding agreement between you and Pocket Memo ("we," "our," or "us").

2. Description of Service

Pocket Memo is a productivity application for iOS devices that allows users to:

  • Record voice notes using the device's microphone
  • Transcribe voice recordings to text using Apple's speech recognition
  • Automatically parse dates and times from voice notes
  • Create local notifications and reminders
  • Integrate with iOS Calendar (optional)
  • Use home screen widgets, Siri shortcuts, and Action Button (iPhone 15 Pro+)

Important: All data is stored locally on your device. We do not provide cloud sync, backup services, or server-side storage. You are responsible for backing up your data through iCloud Backup or other methods.

3. Medical and Critical Use Disclaimer

IMPORTANT SAFETY NOTICE:

Pocket Memo is a productivity and convenience tool for general-purpose note-taking and reminders. DO NOT use Pocket Memo for critical, time-sensitive, or safety-critical tasks, including but not limited to:

  • Medication reminders or schedules
  • Medical appointments or health-critical events
  • Emergency situations or safety alerts
  • Financial deadlines or legal obligations
  • Time-sensitive business operations
  • Any scenario where failure to receive a reminder could result in harm, injury, or significant loss

The App is provided "as-is" without guarantees of accuracy, reliability, or timeliness. Voice recognition, date/time parsing, and notifications may fail or be inaccurate. We are not liable for missed reminders, transcription errors, or any consequences resulting from reliance on the App for critical tasks.

By using Pocket Memo, you acknowledge and accept these limitations and agree to use the App at your own risk.

4. User Accounts and Data

4.1 No Account Required

Pocket Memo does not require user accounts. All data is stored locally on your device.

4.2 Data Ownership

You retain full ownership of all voice notes, transcriptions, and content you create using the App. We do not have access to, claim ownership of, or assert any rights over your data.

4.3 Data Responsibility

You are solely responsible for:

  • Backing up your data (via iCloud Backup or other methods)
  • Securing your device with a passcode, Face ID, or Touch ID
  • Managing storage space on your device
  • Ensuring compliance with applicable laws when recording voice notes (e.g., consent requirements for recording conversations)

5. Voice Data and Privacy

All voice recordings and transcriptions are processed and stored locally on your device. Specifically:

  • Voice Recognition: Performed by Apple's on-device speech recognition framework
  • Data Storage: Stored in the App's secure local database (SwiftData)
  • No Cloud Transmission: Voice notes are never uploaded to our servers or any third-party servers
  • iCloud Backup (Optional): If you enable iCloud Backup, your voice notes may be backed up to your personal iCloud account (controlled by Apple, not us)

6. Acceptable Use Policy

You agree to use the App in compliance with all applicable laws and regulations. You must not:

  • Use the App to record conversations without consent of all parties (where required by law)
  • Use the App to store illegal, harmful, or offensive content
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Circumvent or disable any security features of the App
  • Use the App in a manner that violates Apple's App Store Terms of Service

7. iOS Permissions

The App requires the following iOS permissions to function:

  • Microphone: Required to record voice notes
  • Speech Recognition: Required to transcribe voice to text
  • Notifications: Required to send local reminders
  • Calendar (Optional): Required to create calendar events

You can manage these permissions in your device's Settings app. Disabling required permissions will limit App functionality.

8. Intellectual Property

8.1 App Ownership

Pocket Memo, including its design, code, trademarks, and branding, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8.2 Your Content

You retain all rights to your voice notes and content. By using the App, you do not grant us any license or rights to your content.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Accuracy of voice transcription or date/time parsing
  • Reliability of notifications or reminders
  • Uninterrupted or error-free operation
  • Compatibility with all iOS devices or versions
  • Fitness for a particular purpose

Voice recognition and natural language processing are inherently imperfect technologies. We do not warrant that the App will meet your expectations or that it will be free from bugs or errors.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of data, profits, or business opportunities
  • Damages resulting from missed reminders, transcription errors, or App malfunctions
  • Harm or injury resulting from reliance on the App for critical tasks (see Section 3)

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP (if applicable) OR $50 USD, WHICHEVER IS LESS.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of applicable laws (e.g., recording conversations without consent)
  • Content you create using the App

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Updating the "Last Updated" date
  • Posting a notice in the App or on our website

Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

13. Termination

You may stop using the App at any time by uninstalling it from your device. We may terminate or suspend your access to the App at any time, with or without cause, with or without notice.

Upon termination, all licenses granted to you in these Terms will immediately cease. Data stored locally on your device will remain on your device unless you delete the App.

14. Governing Law and Disputes

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of [Your Jurisdiction].

15. Severability
